A regular meeting of the Board of Trustees of the Village of Montgomery was convened in a public session of the Village Hall, 133 Clinton St, Montgomery, NY 12549 on September 15, 2026 at 6:30 P.M. local time. The meeting was called to order by Mayor Michael R. Hembury, and, upon roll being called, the following were:

PRESENT: Michael Hembury, Deputy Mayor Andolsek, Trustee Picarello, Trustee Nokland, Trustee Imbriani

The following Resolution was offered by Trustee Picarello and seconded  by Deputy Mayor Andolsek.

RESOLUTION NO.  24      2026:

AUTHORIZING THE MONTGOMERY VILLAGE COURT TO APPLY FOR FUNDING FROM THE JUSTICE COURT ASSISTANCE PROGRAM FOR THE 2026-2027 CYCLE GRANT

WHEREAS, the Justice Court Assistance Program (“JCAP”) provides grant funding to assist local courts in improving court operations, administration, and technology; and

WHEREAS, the Montgomery Village Court desires to submit an application for funding through the 2026-27 JCAP grant cycle; and

WHEREAS, a certified resolution of the Village Board authorizing such application is a required component of the grant application.

NOW, THEREFORE, IT IS HEREBY

NOTICE IS HEREBY GIVEN that the Village Board of the Village of Montgomery will hold a Public Hearing to consider enacting a ban on the sale and distribution of kratom products in the Village of Montgomery on Tuesday, October 6, 2026 at 6:30 p.m. or as soon thereafter as practicable at the Montgomery Senior Center, 36 Bridge Street, Montgomery, New York 12549.

PLEASE TAKE NOTICE, that the Planning Board of the Village of Montgomery will hold a Public Hearing on Wednesday, July 22, 2026, at 7:30 P.M. or as soon thereafter as can be heard, at the Montgomery Village Hall, 133 Clinton Street, Montgomery, New York 12549, to consider the application of Mark Gesso, for Subdivision approval.

The project proposes a three-lot subdivision for the premises situated at section 202, block 15, lot 14.2 in the Village of Montgomery, said lot also being known as 64 Union Street. The site consists of a single lot of +/-0.82 acres in the R5 Zone (one family residence) and is currently improved with a single residence.

The Planning Board will hold a public hearing to consider the Subdivision application. The Planning Board has declared itself lead agency for this action.

At the above date, time and place all interested persons will be given an opportunity to be heard. Written comments will be received by the Board no later than the close of the public hearing on July 22, 2026.

NOTICE IS HEREBY GIVEN that the Board of Trustees of the Village of Montgomery, Orange County, New York (the "Village"), at a meeting held on June 2, 2026, duly adopted the resolution summarized below, subject to a permissive referendum.

The resolution provides that the faith and credit of the Village are irrevocably pledged for the payment of the principal of and interest on such obligations as the same respectively become due and payable; that an annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year; that the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the bonds authorized by such resolution, including renewals of such notes, is delegated to the Village Treasurer; that all other matters, except as provided in such resolution, relating to the bonds authorized, including the date, denominations, maturities and interest payment dates, within the limitations prescribed in such resolution and the manner of the execution of the same and also including the consolidation with other issues, and the authority to issue such obligations on the basis of substantially level or declining annual debt service, is delegated to and shall be determined by the Village Treasurer; and that this LEGAL NOTICE shall be published.

The Town of Montgomery will hold a public hearing on Wednesday, May 20, 2026, at 7:00 p.m. at Montgomery Town Hall, 110 Bracken Road, 2nd Floor, Montgomery, NY, to discuss  "A Local Law Amending Chapter 235 Of The Code Of The Town Of Montgomery-Zoning Regarding Definitions And Permitted Uses In Certain Zoning Districts"

 Because the Village of Montgomery is located within the Town of Montgomery, Village residents may be affected by proposed changes to the Town’s zoning law.

Introductory Local Law No. 1 of 2026 would amend Chapter 235 of the Town Code to add definitions and permitted uses related to the film industry and related commercial uses in certain zoning districts. These uses include filming activity, conference centers, hotels and motels, catering halls, restaurants, and related accessory uses.

The proposed law also removes “Automobile Recycling Facility” from the I-1 zoning district table of uses.
